What is a Non Tariff Barrier to trade ?

  • The NTBs are defined in the EAC as “quantitative restrictions and specific limitations that act as obstacles to trade”.
  • Non-Tariff Barriers (NTBs) refer to restrictions that result from prohibitions, conditions, or specific market requirements that make importation or exportation of products difficult and/or costly.
  • NTBs also include unjustified and/or improper application of Non-Tariff Measures (NTMs) such as sanitary and phytosanitary (SPS) measures and other Technical barriers to Trade (TBT).
  • NTBs arise from different measures taken by governments and authorities in the form of government laws, regulations, policies, conditions, restrictions or specific requirements, and private sector business practices, or prohibitions that protect the domestic industries from foreign competition.

Most Common Non Tariff Barriers

  • Unnecessary delays in clearing goods at borders, weighbridges or police road blocks
  • Cumbersome Customs procedures
  • Import bans
  • Restrictive or cumbersome import/export licensing or permit
  • Demand for bribes or unauthorized payments
  • Use of arbitrary and fictitious customs valuation of imports for purpose of charging duty
  • General or product-specific quotas
  • Complex/discriminatory Rules of Origin
  • Varying procedures for issuance of certification marks, inspection and testing
  • Unjustified Sanitary and Phyto-sanitary conditions
  • Unreasonable/unjustified packaging, labelling, product standards
  • Harassment by border official
  • Multiple stops along transport corridors such as weighbridges, police road blocks, customs check points
